We own an ornamental iron business. Who is responsible for proper architecture application?
Owner of home says he wants the fence built a certain way. We see a problem with it. Is it our responsibility to build the fence as they requested or refuse to unless they change the design to be made properly?

- My take on this would be you have a duty to make the fence up to any applicable building code as well as safe. Does the client's design violate these? If so, then I would try for a compromise or a plain refusal. Especially if it violated code, as any building & safety inspector could order it removed anyway. You could potentially be open to a lawsuit of you knowingly built something that was unsafe or in violation of standards.
- You are asking about design. I am assuming that doesn't mean the structural integrity of the fence. I would hold the line at structural integrity, but allow the customer to have their own design. I would also put it into your contract that the customer is responsible to obtain any necessary permits and/or design approvals.
