Is photographing someone else's art copyright infringement?
For example sculptures being displayed in a botanical garden? Since statues and architecture are commonly photographed and those photographs sold, but I think you can’t take a photo of someone’s painting and sell it, I'm not sure where the line is.

- Usually, personal artwork will be copyrighted, but it is down to the individual to apply for copyright of their product. With regard to public display i.e. sculptures etc. these carry a copyright automatically due to being on public display, however, there is no law against taking photographs of these items. If you were to take photographs and sell them of the item, (for profit), you would probably need to contact the company involved in order to gain permission to do so. It isn't black and white really, I daresay there are different rules depending on who is involved with the piece.
